Mobile, Ala. – The Mobile Area Water and Sewer System (MAWSS) and the Alabama Department of Conservation and Natural Resources (DCNR) today announced a settlement in the litigation related to control, access, and regulatory authority over Big Creek Lake, or Converse Lake.
Over the past several months, MAWSS and DCNR undertook good-faith negotiations to reach a settlement that would both protect MAWSS ability to regulate reservoir access to protect water quality while ensuring public recreational access to Big Creek Lake.
“I’m pleased that MAWSS and DCNR could work constructively together and reach this settlement,” said Bud McCrory, MAWSS Director. “This preserves our ability to protect drinking water for 350,000 area residents and take the steps needed to prevent invasive species and other threats to our water supply and water rates. In addition, we are also able to ensure thoughtful public recreational access to the reservoir, preserving outdoor opportunities for area residents and creating new opportunities for people who have previously been unable to access the reservoir.”
“Our department’s role is to protect and enhance public access to Alabama’s natural resources, and this agreement balances the needs to protect water quality with public access,” said Chris Blankenship, Commissioner of the Alabama Department of Conservation and Natural Resources. “I am very appreciative of MAWSS efforts to work with us to produce a plan that achieves both of these goals in a responsible way.”
Public access to Big Creek Lake will be restored for fishing and certain watercraft use, subject to MAWSS management, safety controls, and regulatory conditions designed to protect water quality and prevent the introduction of invasive species.
Per terms of the settlement agreement, and in line with MAWSS previously announced plans, MAWSS will open and operate a recreational facility on Big Creek Lake, including affordable boat rental options and free bank fishing, pier fishing, and picnic areas. Outside kayaks will be allowed, subject to a cleaning process and a small fee. Outside boats will remain prohibited. MAWSS and DCNR will also be working together to develop plans for additional recreational opportunities around Big Creek Lake.
Additional details and an opening date for the recreational facility and related public access will be released in the coming days.
